1. Acceptance of Terms & Operative Entity Details

By accessing, browsing, registering for early access, downloading the browser extension, or utilizing any software features provided by WatchSight, you agree to be bound by these Terms of Service ("Terms") and all incorporated policies. These Terms constitute a legally binding agreement between you and Nicolau Martynyuk, trading as Spectime ("Spectime", "we", "us", or "our"), an individual operating as a sole trader based in London, United Kingdom.

If you do not agree with any part of these Terms, you must immediately discontinue use of WatchSight and uninstall any related browser extension or client tools.

2. Description of Service & AI Valuation Disclaimer

WatchSight provides market intelligence, price evaluation estimates, seller metric aggregation, and authenticity risk scoring software tailored for entry-level and mid-tier luxury timepieces ($3,000–$20,000 USD valuation spectrum).

Important AI Assessment & Decision-Support Disclaimer:

WatchSight risk scores, price assessment outputs, and listing analysis indicators are generated algorithmically for informational and decision-support purposes only. They do not constitute formal financial appraisals, legal guarantees of physical watch authenticity, certified horological inspection reports, or binding investment advice. Users are strongly advised to perform independent due diligence, inspect physical timepieces, and verify credentials before completing high-value luxury transactions.

3. User Accounts & Waitlist Reservations

To access early platform access or premium inspection credits, you may be required to register an account or waitlist reservation with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Accuracy of Information: You agree to provide true, accurate, and current contact details during registration. Accounts registered using temporary or disposable email domains may be removed without prior notice.

4. Acceptable Use Policy & Browser Extension Rules

When using WatchSight or our client-side browser extension, you agree to adhere to the following acceptable use rules:

  • No Reverse Engineering: You shall not decompile, reverse engineer, or attempt to derive the underlying source code or proprietary valuation algorithms of WatchSight.
  • No Automated Scraping: You shall not use automated scripts, bots, spiders, or scrapers to extract aggregate market valuation data or API response payloads from our services.
  • No Rate Limit Circumvention: You shall not bypass API rate limits, security tokens, or authentication mechanisms.
  • Compliance with Marketplace Rules: Your use of the WatchSight browser extension must comply with the terms of service of any third-party watch marketplaces you browse.

5. Subscriptions, Payments & Refund Policy

Paid features, subscription plans, and credit packages are processed securely through Stripe. By purchasing a subscription or credit package, you authorize Spectime to charge your designated payment method for the agreed fees, including applicable statutory VAT or sales taxes.

Cancellation & Refunds: Subscription plans auto-renew unless cancelled prior to the billing renewal date via your billing dashboard. Unused inspection credits or digital service subscriptions are non-refundable once valuation analysis services have been consumed, except where required by mandatory consumer protection laws in your jurisdiction.

6. Intellectual Property & License Rights

All software code, database architecture, design assets, trademarks, trade dress, AI valuation models, and interface elements associated with WatchSight are the exclusive intellectual property of Nicolau Martynyuk trading as Spectime. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use WatchSight for personal or internal business decision-support purposes.

7. Data Protection & Privacy Integration

Our collection, storage, and processing of personal data in connection with your use of WatchSight are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using WatchSight, you consent to our data practices as outlined under UK GDPR and EU GDPR compliance standards.

8. Warranties Disclaimer & Limitation of Liability

To the maximum extent permitted by applicable law, WatchSight is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability: In no event shall Nicolau Martynyuk trading as Spectime be liable for direct, indirect, incidental, special, consequential, or punitive damages (including loss of profits, financial loss on timepiece purchases, or seller marketplace disputes) arising out of or related to your use of or inability to use WatchSight.

9. Termination & Account Suspension

We reserve the right to suspend or terminate your access to WatchSight at any time, with or without cause, and without prior notice, if we reasonably suspect that you have violated these Terms, engaged in fraudulent activity, or attempted to compromise the security or integrity of our systems.

10. Governing Law, Jurisdiction & Legal Contact

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
